Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of 313SESSIONS, operated by GTM LLC. By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. The Platform

313SESSIONS is a marketplace connecting sellers of AI products (prompts, agents, workflows, templates, and services) with buyers. GTM LLC acts as the platform operator, not a party to transactions between buyers and sellers.

3. Accounts

  • You must be 18 or older to use this platform
  • You are responsible for maintaining the security of your account
  • You may not impersonate others or create accounts for fraudulent purposes
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Seller Obligations

  • Listings must accurately describe the product or service
  • Sellers must own or have rights to sell the listed product
  • No listings for illegal, harmful, or deceptive products
  • Sellers are responsible for delivering what they list
  • GTM LLC takes a platform commission on managed sales (8–12%)
  • Sellers must comply with all applicable laws including tax obligations

5. Buyer Obligations

  • Purchases are for personal or commercial use as licensed by the seller
  • Buyers may not redistribute, resell, or claim ownership of purchased products without seller permission
  • Chargebacks filed without first contacting us may result in account suspension

6. Prohibited Conduct

You may not use 313SESSIONS to:

  • Sell or distribute illegal content
  • Commit fraud or deceive other users
  • Infringe intellectual property rights
  • Circumvent platform fees or payment systems
  • Interfere with platform security or functionality
  • Engage in spam, phishing, or harassment

7. Payments

Payments are processed by Stripe. GTM LLC is not responsible for payment processor errors, bank holds, or disputes outside our control. Seller payouts are subject to Stripe's payout schedule and our platform commission.

8. Intellectual Property

GTM LLC owns all rights to the 313SESSIONS platform, brand, and technology. Sellers retain ownership of their listed products. By listing on 313SESSIONS, sellers grant GTM LLC a non-exclusive license to display and promote their listings on the platform.

9. Limitation of Liability

To the maximum extent permitted by law, GTM LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The platform is provided "as is" without warranties of any kind. GTM LLC does not warrant that the platform will be uninterrupted, error-free, or that listings are accurate. We are not responsible for the quality, safety, or legality of listed products.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, not class action litigation, to the extent permitted by law.

12. Changes

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email or platform notice.
